What are the General Terms1. General The following general terms and conditions apply to all orders placed by the customer (hereinafter referred to as "you") with Onrude, hereinafter referred to as "Onrude", "us" or "we", via the Onrude websites. By using onrude.nl and/or placing an order, you accept that you are bound by the terms and conditions below (the "Terms"). Make sure you have read and understood the terms before placing your order. Only persons aged 18 years or older, who are not under guardianship and do not act in the capacity of a company, with a delivery address in the Netherlands (with the exception of the BES and ABC islands) can place an order. Orders paid with iDEAL can be made from the age of 16. The fact that products or services are offered at any time on onrude.nl does not guarantee that these products or services are available at all times. We reserve the right to withdraw products at any time. We reserve the right to change these terms from time to time without prior notice to you. The version of the terms and conditions, which applies to your order, is the version that can be found on onrude.nl at the time of placing your order. Onrude wants to offer you the best possible online experience. To make this possible, we need to make sure that our services run seamlessly. You do not understand or agree (i) to post, transmit, redistribute, upload, or promote any communications or content that may be harmful or adversely affect our businesses, products or services; (ii) not to act in a manner that or not to use a device that restricts, harms, interferes with or inhibits other users from using or enjoying the website, or affects the security of the website, or (iii) does not use a device or attempt to use an engine, software, tool, agent or other device or mechanism (including, but not limited to, , spiders, bots, crawlers, avatars or intelligent agents) to navigate and search the website, or to copy the content of the website. We reserve the right to immediately block access to the site and close the account of users who violate this provision or any other provision in these terms and conditions. 2. Prices and shipping costs The prices stated on onrude.nl include the statutory VAT, but exclude the shipping costs. Printing, typographical errors and price changes reserved. The shipping costs are the same for all orders, regardless of the size and weight of your order. The costs for each shipping option are clearly stated during the ordering process. Our standard shipping costs are € 4.10 within the Netherlands. (If otherwise indicated.) 3. Order/contract termination You can order via onrude.nl, onrude.com and onrude.eu If you have registered your e-mail address, you will receive a confirmation by e-mail after placing an order. In the unlikely event that we are unable to deliver your order, we will let you know as soon as possible. If the order has already been paid for, we will try to refund the payment via the payment method you used. If the refund needs to be made in a different way, Onrude will notify you and ask you to contact customer service who will handle the refund. 4. Delivery Onrude takes the utmost care in the registration and processing of orders and strives to deliver your orders to a residential address or pick-up point in the Netherlands, in accordance with your chosen delivery method. Unfortunately, we cannot deliver to the BES and ABC islands. Your first order will always be delivered to your home address. Onrude strives to process orders as quickly as possible and on a first come first served basis. We strive to deliver within 3 to 5 days after confirmation of an order, unless otherwise agreed. Although we strive to deliver within the set period, delay may arise due to unexpected events. In the unlikely event that the delivery does not take place within 30 days, you can cancel the order. Before you place an order, you will be informed about the expected delivery period. If you have registered your e-mail address, you will receive a confirmation by e-mail after placing an order, containing the expected delivery period. For our full delivery policy, please visit onrude.nl. If your order does not arrive on the scheduled date, please contact customer service. 5. Revocation of an order. You can cancel or return your order from the date you placed the order up to 30 days after receiving the ordered items. If the items have been charged to you, you will receive the amount excluding the standard shipping costs and excluding the return costs, provided that this is the case. For our full return policy, please visit onrude.nl. If you wish to cancel or return your order, please notify us in writing, preferably with the pre-printed return form in your package. Alternatively, you can fill out and submit the local consumer authority's standard form. Return the items as listed below in section 6 (Returns), within a period of 30 days as mentioned above in section 5.1. We will try to refund the money as soon as possible and in the same way as you paid (or, if the items have not yet been paid, settle the return of the items with your balance), no later than 14 days after receipt of your cancellation, provided that we have received the items, or proof that the items have been returned. A different payment method can be used for the refund if you give permission for this. In any case, this will not entail any additional costs. If a received item is defective, please notify Onrude immediately and return the item as set out in section 6 (Returns) below. All products that are registered as defective will be fully reimbursed by Onrude. The provisions in these terms and conditions do not limit any legal rights. 6. Returns Onrude guarantees a full reimbursement of returned items pursuant to paragraph 5 (Revocation of an order), provided that all items are returned in the same condition as they were in upon receipt. This means that the items must not be damaged, dirty, washed, modified or worn (other than fitting the item) and that labels or price tags have not been removed. Shipping costs will be refunded when you return the entire order. It may take up to 14 days for the refund to be processed. All our packages include a pre-printed return form that you can use if you want to return items. More information about our return procedure can be found on the delivery note and in our Return Policy. You can drop off the return package at a postal agency or pick-up point in the Netherlands. You can always return items within 30 days. You can also use your refunds to exchange items or to make new purchases in-store, but only if you've paid through iDeal or a credit card. 7. Payment methods. You can pay for your items in the ways shown below.Credit or debit card (with Visa or Mastercard logo) You can enter your payment details when ordering and use a valid credit or debit card (with VISA or Mastercard logo). The relevant amount will be booked immediately on your credit/debit card and will not be debited until the goods have been shipped. Onrude reserves the right to check the validity of the credit/debit card, as well as the credit limit in relation to the order amount and whether the address details of the buyer are correct. Based on these checks, we can refuse an order. Ideal During the ordering process, you will be redirected to your bank to complete the payment. You have the option to pay via iDeal if you use online banking. Your payment will be debited from your account immediately PayPal / Other You will receive the legally required invoice in the shipping confirmation email. You are required to provide a correct email address and inform Onrude if your email address has changed. 8. Our liability These terms do not limit or exclude Onrude's liability when it comes to matters that we cannot limit or exclude our liability under the law. Onrude accepts liability for fatal or bodily injury caused by our negligence or that of our employees or representatives. We are not looking for exclusion from liability as a result of deception by our employees or representatives. In the event of violation of these Terms, we are solely liable for losses reasonably foreseeable as a result of such violation. Onrude is not responsible for indirect losses that are an additional effect of the original loss or damage, such as loss of profit or loss of opportunity, or failure to deliver goods or non-compliance with any other obligation under these Terms, if such default is the result of events beyond our control , including, but not limited to, fire, flood, storm, uprising, political unrest, war, atomic accidents and terrorist activities. Our total liability to you for losses or damage that have arisen as a result of your order on onrude.nl is limited to the total amount of your order. 9. Colours and dimensions We do everything reasonably possible to display the properties of our products, including the composition and colors, as accurately as possible. The color you see depends on several factors: screen quality, app version, computer system etc. The dimensions of the items on onrude.nl are only guide values. They are meant to give you an idea of the model or fit of that particular item and do not guarantee the actual dimensions of the item you receive. The final dimensions of an item may vary depending on the material used for production. 10. Warranty If the items you have purchased are defective, Onrude will fully comply with the legal warranty regulations. If you have a complaint due to obvious material or manufacturing defects regarding goods delivered by us, including transport damage, you can inform us by returning the goods without delay together with the pre-printed return form. 11. Transfer Onrude reserves the right to transfer or transfer any claims for payment [including any payment terms] in connection with the delivery of goods to a third party. 12. Immunity If any part of these Terms is declared invalid or void by a court or legislator, the remaining Terms shall remain in force. 13. Property rights All intellectual property rights, such as trademarks and copyrights to onrude.nl are vested in Onrude. How to Return my item(s)Take the time to fit all items. If you decide to return item(s), you can fill in the return form in your package and return it to us together with your item(s). Please note: When returning, it is important that the return address corresponds to the courier you want to return with.The return amount of an order where you pay afterwards will be deducted from any outstanding costs on your own account. With the other payment methods, the return amount will be refunded through the payment method you used. If you have lost the return form, you can print out a new form. Each package contains a document with the return address. If you no longer have it, you can mention the return address and answer number on your package below.
